General Terms and Conditions

Please read the following booking terms and conditions carefully, as they set out the terms and conditions of the contract between you and Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris Pty Limited. The following terms of use govern the use of the Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris websites. Read these terms and conditions carefully before you accept these Terms by: (a) placing an order and/or an enquiry through the use of any of our contact forms on our Websites, or (b) otherwise using the Websites. If you do not agree with all of these terms and conditions, do not make use of the Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris websites.

Bookings

Fifth Avenue 4×4 Adventure Tours, trading as East Cape Tours and Safaris, requires a non-refundable deposit of at least 35% of the total package price within 24 hours of confirming your bookings, except for late bookings, to secure your reservation. At the time of booking, we will inform you about the payment required for your specific chosen travel arrangements. Please note that nowadays, many service providers require 100% pre-payment within 24 hours of confirmation. You must pay the balance of the cost of your travel arrangements no later than nine weeks before departure. If you make a booking within nine weeks of departure, you must pay the total cost of your travel arrangements at the time of booking.

Please note: FAILURE TO PAY ON TIME WILL RESULT IN THE AUTOMATIC CANCELLATION OF YOUR BOOKING.

Air/Train tickets

The air/train fare and taxes quoted are current and are subject to change without prior warning should the airline or train travel provider impose an increase in rates for any reason. If the quoted fare is unavailable during the booking process, we will proceed to book the next applicable fare and inform you of any adjusted costs accordingly. It is important to note that fares may increase between the time of booking, payment, and the issuance of the ticket.

Fifth Avenue 4×4 Adventure Tours, trading as East Cape Tours and Safaris, cannot assume responsibility if airlines or railway operators discontinue flights or train journeys on specific routings or alter scheduled timetables, leading to missed connections. Should an amendment in routing or itinerary be necessary, any additional costs incurred will not be borne by Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris. Fifth Avenue 4×4 Adventure Tours, trading as East Cape Tours and Safaris, cannot guarantee the prices and conditions of airfares and train fares, as they are subject to the quotes provided by specific airlines and/or railways. The onus is on the agent and the passenger to check that there have been no changes in these prices before making final payment thereof.

Methods of Payment

Credit Cards (Master Card and Visa): In accordance with International Airline Travel Association (IATA) bulletin # A1/00 and our bank ABSA, we need a signed and validated Standard Credit Card Charge Form. The agent acknowledges that he/she has seen the card or received a copy of the card and that the signature on the card is the same as that on the Credit Card Charge Form. If the card is a foreign credit card then you may be requested to supply various other details.

Cheques: Bank issued cheques only! Please be aware that we need 7 working days to process and clear all cheques before we can issue documents or confirm travel arrangements. For cash or EFT transfers, we accept payments made through EFT transfers or cash deposited into one of our bank accounts. However, you must provide us with the EFT transmission report or the cash deposit slip, and we will confirm the receipt of payment. Please make sure to make all payments in full and without any bank charges.

Insurance

We consider adequate travel insurance to be essential. All premiums must be paid at the time of booking, as cover will not be effective until then. Fifth Avenue 4×4 Adventure Tours trading as East Cape Tours and Safaris will not be liable if anyone should fail to take adequate insurance cover.

Flight/Train Travel Timings

Flight/Train travel timings and other timings are provided by airlines and/or railways and are subject to Air Traffic Control restrictions. All means of transportation are subject to weather conditions, the need for constant maintenance, and the ability of passengers to check-in on time. There is no guarantee that flights, ferries, ships, trains or coaches will depart at the times stated on any itinerary, voucher or tickets which you receive. All timings are estimates only, and we do not accept any liability for any delay, however arising, or for any schedule alterations.

Flight/Train Travel Reconfirmation

It is your responsibility to ensure that you reconfirm the departure date and times of all your flight arrangements and train journeys at least 72 hours prior to departure. This is particularly important in respect of subsequent train journeys in South Africa and flights leaving South Africa. Fifth Avenue 4×4 Adventure Tours, trading as East Cape Tours and Safaris, expressly excludes any liability and cannot be held responsible for any direct, indirect, special, incidental, or consequential damages that may arise due to delays or failures by travel service providers, such as accommodations, car hire, shuttle service, or any other losses resulting from your failure to reconfirm flight, train journeys, or connecting flight details.

Documents

We will only prepare documents (vouchers, etc.) upon receiving full payment of the package price. Once we receive the payment, we will prepare the documents within 72 working hours. Should you require hard copies of your documents and air tickets to be forwarded to either yourself or the departure airport and or train station, this may be arranged. These will be sent by e-mail. However, the courier costs in respect thereof will be for your own account.

Passports, Visas and health

The client is solely responsible for ensuring that all passports and visas are current, valid, obtained on time, and will remain valid for 6 months after returning to their home country. It is also the client’s responsibility to obtain any required vaccinations, inoculations, prophylactic treatments (e.g., for malaria), and other necessary measures as needed. This also includes all necessary documentation required for travelling with minors. There are specific requirements for children under 18 travelling to South Africa, including but not limited to unabridged birth certificates

Forced Changes to Your Itinerary

We hope and expect to be able to provide you with all of the services we have confirmed to you at the time of booking. We plan arrangements a long time in advance of your holiday. Making use of independent suppliers such as hotels etc. over whom we have no control. On some occasions, changes do have to be made, and we reserve the right to make these.

Cancellation Terms

Our standard cancellation policy states that if you cancel your travel plans before 9 weeks of the scheduled travel, you will forfeit the full 35% deposit. In case of cancellation between 9 and 6 weeks prior to the travel date, you will forfeit 50% of the total cost. If you cancel your travel plans less than 6 weeks before the travel date, you will forfeit the entire total cost.
